Direttiva per la guida dei motocicli nel caso di minorazioni invalidanti ag=
li
arti.</span></strong></p>

<p><strong><u><span style=3D'font-size:10.0pt;font-family:Verdana'>A) PREME=
SSE</span></u></strong><span
style=3D'font-size:10.0pt;font-family:Verdana'><br>
<br>
L&#8217;abrogazione, da parte dell&#8217;art<span class=3DSpellE>.7</span> =
della
legge 1&deg; agosto 2003 n<span class=3DSpellE>.214</span>, del 5&deg; comma
dell&#8217;art. 327 del Regolamento di esecuzione ed attuazione del Codice
della Strada che impediva il rilascio o la conferma di validit&agrave; della
patente per la guida dei motocicli ai conducenti con minorazioni agli arti,=
 ha
ricondotto l&#8217;esame dei casi in specie nell&#8217;ambito di quelli,
pi&ugrave; in generale, regolamentati ex 2&deg; comma del medesimo articolo
327, l&agrave; dove questo dispone che &#8220;sulla base delle direttive
impartite dal Comitato tecnico di cui all&#8217;art<span class=3DSpellE>.11=
9</span>,
comma 10, del Codice, la funzionalit&agrave; delle protesi e delle <span
class=3DSpellE>ortesi</span> o l&#8217;individuazione degli adattamenti deve
essere verificata dalla Commissione medica locale&#8221;.<br>
Le Commissioni mediche locali, quindi, finora impossibilitate a rilasciare
certificazioni di idoneit&agrave;, stante la mancanza di specifiche diretti=
ve
del Comitato tecnico, potranno ora operare in forza delle indicazioni conte=
nute
nella presente direttiva e per i casi ivi definiti.<br>
A tale proposito si fa osservare che detta direttiva &egrave; stata elabora=
ta
anche sulla base delle concomitanti esperienze di esperti del settore quali
ortopedici, costruttori di protesi, costruttori di motocicli e associazioni
motociclistiche.<br>
Al momento sono stati regolamentati i casi riguardanti i pi&ugrave; frequen=
ti
tipi di minorazioni, senza tuttavia escludere, in linea di principio, di po=
ter
prendere in esame in futuro, l&agrave; dove possibile, casi riguardanti tip=
i di
minorazioni pi&ugrave; complesse.<br>
<br>
<strong><u><span style=3D'font-family:Verdana'>B) MINORAZIONI INVALIDANTI</=
span></u></strong><br>
<br>
Ai sensi del primo comma dell&#8217;art. 321 del citato Regolamento, &#8220=
;Sono
da giudicare invalidanti, ai fini della guida, le alterazioni anatomiche o
funzionali, considerate singolarmente e nel loro insieme, tali da menomare =
la
forza o la rapidit&agrave; dei movimenti necessari per eseguire con sicurez=
za
tutte le manovre inerenti alla guida di quei determinati tipi di veicoli ai
quali la patente abilita&#8221;.<br>
Nella fattispecie della guida dei motocicli, la valutazione circa
l&#8217;efficienza degli arti, superiori ed inferiori, acquista ovviamente =
un
particolare rilievo in considerazione delle fondamentali funzioni di
stabilit&agrave; e di manovrabilit&agrave; del veicolo che gli arti stessi =
sono
chiamati a svolgere.<br>
Qualora quindi tutte le verifiche di funzionalit&agrave; non siano favorevo=
li,
si proceder&agrave; secondo le indicazioni seguenti.<br>
<br>
<strong><u><span style=3D'font-family:Verdana'>C) STABILITA&#8217; DEL MOTO=
CICLO</span></u></strong><br>
<br>
E&#8217; di immediata evidenza che a differenza dei veicoli a 3-4 ruote - d=
ove
la stabilit&agrave; &egrave; assicurata dalla loro stessa conformazione- nel
caso dei motocicli la stabilit&agrave; deve essere necessariamente assicura=
ta
dal conducente, il quale deve essere in grado di mantenere la posizione ere=
tta
del veicolo in qualunque circostanza, avvalendosi di ambedue gli arti<br>
inferiori.<br>
Ne discende quindi che -<strong><span style=3D'font-family:Verdana'>a presc=
indere
dall&#8217;azionamento o meno dei comandi</span></strong>- ambedue gli arti
inferiori, ancorch&eacute; <span class=3DSpellE>protesizzati</span>, <span
class=3DSpellE>ortesizzati</span> o parzialmente limitati funzionalmente, d=
ebbono
essere affidabili ai fini della stabilit&agrave; del motociclo.<br>
Nel corso degli accertamenti propedeutici alla presente direttiva, si &egra=
ve;
constatato che <strong><span style=3D'font-family:Verdana'>nel caso di
amputazione o <span class=3DSpellE>agenesia</span> parziale <span class=3DS=
pellE>mono</span>/bilaterale
di gamba o parziale o totale di piede, con integrit&agrave; funzionale sia =
del
ginocchio che dell&#8217;anca</span></strong>, le protesi sono assolutamente
affidabili, l&agrave; dove concepite e realizzate, per l&#8217;appunto, per=
 la
guida dei motocicli; <strong><span style=3D'font-family:Verdana'>nel caso di
limitazione funzionale di uno o di ambedue gli arti inferiori compensata co=
n <span
class=3DSpellE>ortesi</span> di piede o di gamba-piede</span></strong>, par=
imenti
affidabili, alle medesime condizioni, possono ritenersi le <span class=3DSp=
ellE>ortesi</span>,
siano esse calzature ortopediche, molle di <span class=3DSpellE>Codivilla</=
span>
o simili.<br>
<br>
Per verificare le necessarie condizioni di funzionalit&agrave; del ginocchi=
o e
dell&#8217;anca, bisogner&agrave; accertare, riguardo al <strong><span
style=3D'font-family:Verdana'>ginocchio</span></strong>, che questo abbia u=
na
capacit&agrave; di <span class=3DSpellE>flesso-estensione</span> attiva da
90&deg; a 180&deg;; per l&#8217;<strong><span style=3D'font-family:Verdana'=
>anca</span></strong>
soccorrer&agrave; invece il test funzionale detto &#8220;posizione di
TRENDELENBURG&#8221; consistente, come &egrave; noto, nel mantenimento
dell&#8217;atteggiamento <span class=3DSpellE>ortomorfico</span> del bacino=
 in
posizione eretta <span class=3DSpellE>monopodalica</span> sull&#8217;arto (o
sugli arti) interessato/i.<br>
Analogo accertamento riguardante il ginocchio e l&#8217;anca dovr&agrave;
essere effettuato per verificare -ai fini della stabilit&agrave; del motoci=
clo-
l&#8217;efficienza dell&#8217;(o degli) arto/i inferiore/i nel caso di <str=
ong><span
style=3D'font-family:Verdana'>limitazione/i funzionale/i non compensabile c=
on <span
class=3DSpellE>ortesi</span></span></strong>.<br>
Si &egrave; constatato altres&igrave; che la stabilit&agrave; del veicolo, =
in
qualunque condizione di guida, pu&ograve; essere assicurata anche qualora il
conducente sia portatore, soltanto <span class=3DSpellE><strong><span
style=3D'font-family:Verdana'>monolateralmente</span></strong></span>, di <=
strong><span
style=3D'font-family:Verdana'>protesi di coscia</span></strong>, sempre che=
 sia
conservato almeno il 3&deg; superiore di coscia ed, anche in questo caso, la
protesi sia concepita e realizzata per la guida dei motocicli. Sar&agrave;
indispensabile, anche nel caso in specie, verificare la funzionalit&agrave;=
 del
ginocchio artificiale (<span class=3DSpellE>flesso-estensione</span> assist=
ita da
90&deg; a 180&deg;) e dell&#8217;anca (posizione di TRENDELENBURG).<br>
<br>
<strong><span style=3D'font-family:Verdana'>In tutti i casi e per i motivi =
sopra
citati, la certificazione di idoneit&agrave; ai sensi del 3&deg; comma
dell&#8217;art. 327 del Regolamento <span class=3DSpellE>C.d.S</span>.,
dovr&agrave; precisare trattarsi di protesi o di <span class=3DSpellE>ortes=
i</span>
&#8220;</span></strong><em><b><span style=3D'font-family:Verdana'>per guida
motocicli</span></b></em><strong><span style=3D'font-family:Verdana'>&#8221=
;.</span></strong><br>
<br>
<strong><u><span style=3D'font-family:Verdana'>D) <span class=3DSpellE>STER=
ZABILITA&#8217;</span>
DEL MOTOCICLO</span></u></strong><br>
<br>
<strong><span style=3D'font-family:Verdana'>A prescindere dall&#8217;aziona=
mento
o meno dei comandi posti sul manubrio</span></strong>, la <span class=3DSpe=
llE>sterzatura</span>
del motociclo deve essere assicurata <strong><span style=3D'font-family:Ver=
dana'>mediante
il movimento del manubrio stesso con ambedue gli arti superiori, anche se u=
no
di essi &egrave; <span class=3DSpellE>protesizzato</span>, <span class=3DSp=
ellE>ortesizzato</span>
o parzialmente limitato funzionalmente.</span></strong><br>
<br>
<strong><span style=3D'font-family:Verdana'>In ogni caso di minorazione
all&#8217;arto superiore</span></strong> (per amputazione, <span class=3DSp=
ellE>agenesia</span>
o limitazione funzionale), condizione assolutamente <span class=3DSpellE>in=
eludibile&egrave;</span>
che <strong><span style=3D'font-family:Verdana'>sia conservata la perfetta
naturale <span class=3DSpellE>articolarit&agrave;</span> scapolo-omerale.</=
span></strong><br>
<br>
<strong><span style=3D'font-family:Verdana'>Nel caso di parziale perdita
anatomica del braccio</span></strong>, &egrave; necessario che lo stesso sia
conservato almeno per met&agrave;. Il <strong><span style=3D'font-family:Ve=
rdana'>gomito</span></strong>
(artificiale) dovr&agrave; avere una capacit&agrave; di <span class=3DSpell=
E>flesso-estensione</span>
assistita almeno da 90&deg; a 180&deg;. La <strong><span style=3D'font-fami=
ly:
Verdana'>mano</span></strong> (artificiale) dovr&agrave; essere in grado di
manovrare autonomamente il manubrio.<br>
<br>
<strong><span style=3D'font-family:Verdana'>Nel caso di perdita anatomica
dell&#8217;avambraccio o della mano</span></strong> (con integrit&agrave;
funzionale del gomito), la protesi -sia essa di tipo funzionale che di tipo
estetico- come nel caso precedente dovr&agrave; consentire l&#8217;autonoma
manovrabilit&agrave; del manubrio.<br>
<br>
<strong><span style=3D'font-family:Verdana'>Nel caso di limitazione funzion=
ale
dell&#8217;arto superiore</span></strong> tale da essere considerata <stron=
g><span
style=3D'font-family:Verdana'>invalidante ai fini della guida</span></stron=
g>,
&egrave; necessario che sia comunque conservata una capacit&agrave; di <span
class=3DSpellE>flesso-estensione</span> attiva del <strong><span
style=3D'font-family:Verdana'>gomito</span></strong> sufficiente per la
manovrabilit&agrave; del manubrio anche con l&#8217;arto minorato. <br>
Riguardo al complesso <strong><span style=3D'font-family:Verdana'>polso-man=
o</span></strong>,
questo <span class=3DSpellE>-ancorch&egrave;</span> non idoneo per l&#8217;=
azionamento
dei corrispondenti comandi al manubrio- dovr&agrave; conservare la
capacit&agrave; di presa del manubrio, <strong><span style=3D'font-family:V=
erdana'>eventualmente
con il supporto di una specifica <span class=3DSpellE>ortesi</span></span><=
/strong>.<br>
<br>
<strong><span style=3D'font-family:Verdana'>In tutti i casi in specie, la
certificazione di idoneit&agrave; ex 3&deg; comma dell&#8217;art. 327 del
Regolamento C.d.S. dovr&agrave; precisare trattarsi di protesi od <span
class=3DSpellE>ortesi</span> &#8220;</span></strong><em><b><span
style=3D'font-family:Verdana'>per guida motocicli</span></b></em><strong><s=
pan
style=3D'font-family:Verdana'>&#8221;.</span></strong><br>
<br>
<strong><u><span style=3D'font-family:Verdana'>E) AZIONAMENTO DEI COMANDI</=
span></u></strong><br>
<br>
<strong><u><span style=3D'font-family:Verdana'>Arti inferiori</span></u></s=
trong><br>
<br>
<strong><span style=3D'font-family:Verdana'>Nel caso di protesi o di <span
class=3DSpellE>ortesi</span> o di limitazione funzionale dell&#8217;articol=
azione
<span class=3DSpellE>tibio-tarsica</span></span></strong>, non &egrave; pos=
sibile
affidare all&#8217;arto o agli arti interessati l&#8217;azionamento di alcun
comando; le relative leve di azionamento a pedale del cambio di velocit&agr=
ave;
e del freno posteriore dovranno essere quindi sostituite da comandi manuali=
 od
anche -nel caso del cambio di velocit&agrave;- da un cambio automatico, sec=
ondo
le prescrizioni del prontuario allegato.<br>
<br>
<strong><u><span style=3D'font-family:Verdana'>Arto superiore</span></u></s=
trong><br>
<br>
I comandi di serie posti in corrispondenza dell&#8217;arto invalido dovranno
essere spostati, ove possibile, dalla parte del braccio valido o sostituiti=
 con
dispositivi automatici o comunque idonei, secondo le prescrizioni del
prontuario allegato.<br>
<br>
<strong><u><span style=3D'font-family:Verdana'>F) ADATTAMENTI DEI COMANDI</=
span></u></strong><br>
<br>
Ai sensi del 4&deg; comma del gi&agrave; citato art. 327, le modifiche
apportate ai comandi dovranno essere di tipo approvato e collaudate secondo=
 le
medesime procedure gi&agrave; attuate per gli autoveicoli.<br>
<strong><span style=3D'font-family:Verdana'>I comandi preesistenti, per mot=
ivi di
sicurezza, dovranno essere eliminati o neutralizzati.</span></strong><br>
<br>
Il prontuario allegato compendia le situazioni sopra illustrate, specifican=
do,
nel dettaglio, per i vari casi, la categoria di minorazione e le relative
prescrizioni.</span></p>

il termine di 'cambio <span class=3DSpellE>automatico'</span> si intende un
dispositivo automatizzato di qualsiasi tipo che elimini la necessit&agrave;
della frizione e del variatore meccanico delle marce.</span></p>

Qualora sul motociclo di serie vengano apportate modifiche per ottemperare =

prescrizioni della Commissione medica, il veicolo cos&igrave; adattato
dovr&agrave; essere sottoposto a collaudo presso un ufficio della
